Self-Settled Trust - A self-settled trust is one in which the person who creates and funds it is also a beneficiary, protected from creditors only in states that authorize asset-protection trusts.
Under traditional trust law, a settlor could not shield assets by putting them in a trust that still benefits the settlor, because creditors could reach anything the settlor retained access to. A handful of states changed that by statute. Nevada, for example, allows a self-settled spendthrift trust under Nev. Rev. Stat. Chapter 166, and Wyoming permits qualified self-settled trusts, which is the legal engine that makes a Domestic Asset Protection Trust possible.
A concrete example: a founder funds a Nevada self-settled trust, names an independent qualified trustee, and remains a discretionary beneficiary. After the statutory seasoning period, future creditors generally cannot force distributions to satisfy claims. The catch, and the most common misconception, is that this works retroactively. It does not. Transfers made to hinder existing or foreseeable creditors are voidable as fraudulent, so the structure protects against future risk, not present lawsuits.
Self-settled trusts pair naturally with anonymous LLCs. A Wyoming or Nevada trust can hold the membership interests of an anonymous LLC, adding a self-settled asset-protection barrier on top of the LLC's charging-order protection and its private state record, so a creditor faces both the trust and the entity. Because both the leading trust states and the strongest anonymous-LLC states overlap in Wyoming and Nevada, founders sometimes build the two layers in the same jurisdiction to keep governing law and trustees consistent.
The error to avoid is treating a self-settled trust as a do-it-yourself add-on. These trusts carry ongoing trustee duties, statutory seasoning periods, and strict formalities, and a poorly drafted one can be disregarded entirely. For most founders an anonymous LLC alone provides sufficient privacy and charging-order protection; a self-settled trust is an advanced layer for high-net-worth owners with elevated liability exposure, and it should be built with specialized counsel.
