One Wyoming LLC opens brokerage accounts in the entity's name using the EIN and holds futures, options, and equities across multiple brokers under a single structure. Fund the accounts from the LLC bank account, never personal funds. The LLC becomes the account holder of record, so state filings show the entity while the broker knows you through KYC and the IRS knows you through the K-1. Trading personal money through the LLC account pierces the veil, so keep contributions and distributions documented. Trader tax status (TTS) is an IRS classification that treats trading as a business and unlocks business deductions; the Section 475(f) mark-to-market election is a separate filing that converts trading gains and losses to ordinary income and exempts them from wash-sale rules. The two are independent of the LLC and of each other. TTS depends on trading frequency, volume, and intent. The 475(f) election must be filed by March 15 of the year it takes effect for existing taxpayers, and missing that deadline defers it a full year. Confusing the two, or assuming forming the LLC grants either, is a common and costly error.
Elect S-corp status via Form 2553 once net trading income consistently exceeds about $60,000 per year. Below that, S-corp payroll compliance costs more than the self-employment tax it saves. Under S-corp treatment the trader-member draws a reasonable salary through payroll and takes the remainder as a distribution, which extracts earnings tax-efficiently and can support retirement-plan contributions tied to wages. Failing to pay a reasonable salary invites the IRS to recharacterize all income as wages. Time the election and any trader-status filing at year start, because forming the LLC mid-year complicates both.
Wyoming levies no state income tax, so the LLC generates no state-level capital-gains liability, which for an active trader can be the largest single ongoing cost. That advantage is the core reason traders choose Wyoming. The benefit is at the state entity level. If you live in a high-tax state such as California or New York, personal income tax on the K-1 income still applies at your home-state rate, because your residency determines personal taxation. A trader who relocates to a no-tax state captures the full benefit. Charging order protection under Wyoming statute also shields the trading account from personal creditors.
Interactive Brokers accepts Wyoming LLC accounts routinely and is the most flexible for non-resident-owned LLCs; TradeStation and other institutional-friendly brokers also open entity accounts using the LLC's EIN. Open the brokerage account in the LLC's legal name once the formation documents and EIN are in hand, then fund it from the LLC bank account to keep the entity clean. Non-resident traders form the Wyoming LLC with no US visit and obtain the EIN by IRS fax without an SSN. Brokerage acceptance for non-residents varies by firm, and Interactive Brokers is the standard choice for that reason.
Fund the brokerage account by transfer from the LLC business bank account, and route withdrawals back to that same account. Both the bank account and the brokerage account are held in the LLC's name under its EIN, so money stays inside the entity. This keeps a clean trail that separates trading capital from personal funds and preserves the liability shield. Depositing personal money straight into the brokerage, or pulling trading proceeds into a personal account, pierces the veil and undermines the structure. Record owner contributions and distributions as they happen so the capital account reconciles at year end.
